Agreement to these terms
These terms govern your use of theforwardstudio.co and the services provided by The Forward Studio LLC, an operations practice registered in North Carolina. By using this site or engaging us, you agree to these terms.
Where you sign a separate proposal, statement of work, or service agreement with us, that document governs the engagement, and these terms fill any gaps it leaves.
What we do
We are an operations practice. We provide operational audits, systems implementation, process documentation, and fractional operations leadership for owner-operated small and mid-size businesses.
We are not attorneys, accountants, tax advisers, or licensed financial advisers. Nothing we produce is legal, tax, accounting, or investment advice, and it should not be relied on as a substitute for advice from a qualified professional in those fields.
Engagements, scope, and proposals
Work begins from a written proposal that sets out the scope, deliverables, timeline, and price. Work outside that scope is quoted separately before it is started.
Fixed-price packages are scoped to what is described in the proposal. Where discovery reveals materially more complexity than was disclosed to us, we will tell you before continuing and agree a revised scope or price with you in writing.
Fees and payment
- Prices shown on this site are starting prices and are subject to scoping.
- Payment terms are set in each proposal. Unless stated otherwise, packaged builds are invoiced 50 percent to begin and 50 percent on delivery.
- Retainers are billed monthly in advance.
- Invoices are due within 14 days unless the proposal says otherwise.
- We may pause work on an account with an invoice more than 30 days overdue.
Where an engagement requires third-party software subscriptions, those are billed by the provider to you directly, or passed through at cost, as set out in your proposal.
Cancellation and rescheduling
Discovery calls can be rescheduled or cancelled at any time using the link in your confirmation.
For active engagements, either party may end the work with 14 days written notice. You pay for work completed and costs committed up to that point. Retainers may be cancelled with 30 days written notice after any minimum term stated in your agreement.
Your responsibilities
Our work depends on access and input from you. You agree to provide timely access to the people, systems, accounts, and information the work requires, and to give feedback within the windows set in the proposal.
Delays in access or feedback move the timeline. Where a project stalls on your side for more than 30 days, we may invoice for work completed and close the engagement.
Ownership of what we produce
Documentation, process maps, standard operating procedures, and system configurations we create specifically for you become yours on full payment. You may use, edit, and keep them without restriction.
We retain ownership of our own templates, frameworks, methods, and general know-how, including anything we used to make your deliverables. Nothing in an engagement prevents us from using that underlying knowledge for other clients.
Third-party platforms
Our work often configures software we do not own or control, including customer relationship platforms, scheduling tools, and payment processors. Your use of those platforms is governed by their terms, and their availability, pricing, and features are outside our control. We are not responsible for a third-party platform changing, failing, or ending its service.
Text messaging terms
If you give us your mobile number, you consent to receive text messages from us about your enquiry, appointments, and active work.
- Message frequency varies.
- Message and data rates may apply for messages sent to you from us and to us from you.
- Reply STOP at any time to opt out. You will receive one confirmation message and no further texts.
- Reply with the keyword HELP for more assistance, or email info@theforwardstudio.co.
- Carriers are not liable for delayed or undelivered messages.
How we handle the information you send us by text is described in our Privacy Policy.
Confidentiality
We treat your business information as confidential and use it only to do the work. We will not name you as a client publicly, or describe your engagement in any case study, without your written permission.
You agree to treat our proposals, pricing, and methods as confidential in the same way.
No guarantee of results
We bring 25 years of operations experience and we do careful work, but business outcomes depend on factors outside our control, including your market, your team, and how the systems we build are used after we hand them over. We do not guarantee specific revenue, savings, time recovered, or other business results.
Limitation of liability
To the fullest extent permitted by law, our total liability arising from any engagement is limited to the fees you paid us for that engagement. We are not liable for indirect, incidental, consequential, or punitive damages, including lost profits or lost data.
Governing law
These terms are governed by the laws of the State of North Carolina, without regard to its conflict of law provisions. Any dispute will be brought in the state or federal courts located in Wake County, North Carolina.
Changes to these terms
We may update these terms. The date at the top of this page shows when they last changed. Continued use of the site after a change means you accept the updated terms. Active engagements continue under the terms in force when the proposal was signed.
